The status of Intellectual Property Rights in India from users’ point of view was discussed.   

Highlights of the discussion were  

  • That there are sufficient legal provisions for protection to IPR but the machinery   to enforce the same needs to be strengthened.
  • India is ripe for joining   Madrid   Protocol in view of consistency by the Trade Marks Registry to keep the backlog of not more than 6 months in issuing the objections to the registration, which is well within the time granted under the Madrid Protocol. The infrastructure of the Trade Marks Registry needs to be strengthened & officers are to be provided adequate   training in international registration of Trade Marks.

    • USA has joined Madrid Protocol   in 2003 
    • WIPO has now reduced fees for registration of application for registrants emanating from least developed countries.  This is a healthy sign. It would be another good gesture from WIPO to encourage registration from Individuals & Partnership Firms, if the fees are further reduced. It may be mentioned that large numbers of applications for   registrations in   India are from individuals & Partnership Firms.  It will be   a boon   for Indian applicants if registrants fees are reduced for single proprietor & Partnership Firms.
